How Do You Sell an Inherited House Held in a Trust in Rocklin?
When a parent's house in Rocklin is held in a living trust, the person named as successor trustee is usually the one who sells it. Many trustees are adult children doing this for the first time, often while grieving.
Surroundings sells trust and probate homes alongside the family's attorney. Here is how a trust sale works in Rocklin, step by step.
Does a house in a trust have to go through probate?
Usually it does not. The California courts' self-help pages list property held in a living trust among assets that typically pass without formal probate, as long as the house was titled in the trust.
If the deed was never transferred into the trust, the house may still need probate in Placer County Superior Court. Check the deed first. A trust that names a house it never received does not keep it out of court.
What does the successor trustee need to do first?
The trustee gathers the trust document, a death certificate and the deed, then takes control of the property. That means keeping insurance in force, utilities on and the house secured.
The trustee also has a notice to send. California Probate Code section 16061.7 requires the trustee to serve a notification on beneficiaries and heirs within 60 days after the trust becomes irrevocable, which usually happens at the death. The notice tells them they can request a copy of the trust.
Can the trustee sell before the contest period ends?
Often the trustee can, but talk to the trust's attorney first. The notice warns that a person may not bring an action to contest the trust more than 120 days after it is served, or 60 days after a copy of the trust is delivered during that window, whichever is later.
Many trustees list the home during that period and plan the closing for after it. Others wait. That choice depends on the trust's terms, the family and the attorney's advice. We build the listing timeline around it either way.
Does the house need a new appraisal or a cleanout?
Two things help the trust's records and the sale. First, the trustee often gets a date-of-death appraisal, which the CPA may need for tax reporting. Ask the attorney or CPA whether you need one before the house is listed.
Second, the house usually needs to be cleared before it shows well. Beneficiaries should agree on what each person keeps before an estate sale company or donation service comes in. We can coordinate those vendors and the repairs, so the trustee is not managing all of it alone.
What Rocklin details affect the sale?
Mello-Roos is the main one. The City of Rocklin's Mello-Roos FAQs say its 11 districts are levied with property taxes, and some can rise 2% to 4% a year. Some fund services with no end date.
When a home sits in one of those districts, California Civil Code section 1102.6b requires the seller to make a good-faith effort to get the notice of special tax and give it to the buyer. We pull the tax bill early so that notice is ready. Rocklin has been a city since 1893, so the housing ranges from older homes near downtown to newer master-planned streets, and each comes with different disclosures.
What happens to the money after the sale?
The sale proceeds go to the trust, not to the beneficiaries directly. Escrow pays off any mortgage, the costs of sale and the property taxes owed, then sends the rest to the trust's account.
From there, the trustee pays the trust's debts and expenses and distributes what remains as the trust directs. How and when that happens is a question for the trust's attorney and CPA. Final tax returns sometimes need to be filed first.
If beneficiaries disagree with the trustee, the Placer County Superior Court can get involved. Court self-help pages note that living trusts can come before a judge when the trust's language is unclear or a beneficiary thinks the trustee is not acting properly. Clear updates to every beneficiary, with copies of offers and the closing statement, prevent most of those disputes.
Should the heirs sell, keep or rent the house?
That is a family decision with tax effects, so bring in the CPA. Heirs who want to keep the home should read about Prop 19, which changed when an inherited home can keep a parent's property tax base.
Our Prop 19 guide explains the basics. If the heirs sell, we give the trustee a custom home valuation and a plan for any repairs or cleanout, so everyone sees the same numbers.
